EULA - End User License Agreement

EnergyProbe 5 (C) MiloSlick Scientific

Summary:

* Internet access is required to activate EnergyProbe.

* You may install your EnergyProbe registration code on up to 2 computers, but only you may use them.

* You agree not to share your registration code or use someone else's code.

* Academic users: you cannot use EnergyProbe for commercial purposes.

* You agree to allow MiloSlick Scientific to validate your license key via the Internet from time to time.

End User License Agreement (EULA) for MiloSlick Scientific software:

MiloSlick Scientific of Chico California is the owner, developer and sole copyright holder of this product, which is licensed -not sold- to you on a non-exclusive basis.

EnergyProbe requires an internet connection to complete the activation process. If you don't have an internet connection, call our support department to complete the activation by phone.

You are entitled to install your EnergyProbe registration code on one operating system on up two computers (i.e. a desktop and a laptop computer), but you agree that you will be the only user.

You agree not to share your EnergyProbe registration code with anyone.

You agree to only use the registration code provided directly to you by MiloSlick Scientific.

You may transfer your EnergyProbe registration code to another person only after receiving written authorization from MiloSlick Scientific and only if the recipient agrees to be bound by the terms of this agreement.

If you are using an academic license key, you are restricted from using EnergyProbe for any revenue-generating activity. If you would like to use EnergyProbe for commercial purposes you must first upgrade from an academic license to a standard license.

You agree to allow EnergyProbe to transmit from time to time via SSL, information required to validate your registration code.

If you are using a trial registration code, you are only entitled to use EnergyProbe for evaluation and testing purposes until the end of your trial period.

You agree not to decompile, reverse engineer or modify any part of EnergyProbe.

MiloSlick Scientific reserves the right to cancel the registration code(s) of any user who MiloSlick Scientific determines is in violation of this agreement.

THE WARRANTIES IN THIS AGREEMENT REPLACE ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE SOFTWARE IS PROVIDED "AS IS" AND MILOSLICK SCIENTIFIC DISCLAIMS AND EXCLUDES ALL OTHER WARRANTIES. IN NO EVENT WILL MILOSLICK SCIENTIFIC BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, EVEN IF WE HAVE KNOWLEDGE OF THE POTENTIAL LOSS OR DAMAGE.

If you are located in the United States this agreement is subject to the laws of the state of California. If you are located outside the United States local law may apply. Some states do not allow the exclusion of warranties, so the above exclusion may not apply to you.

You agree that you will not export or re-export EnergyProbe to any country, person, entity or end user subject to U.S.A. export restrictions.
